Welcome to PuffLab's Terms and Conditions of Use ("Terms of Use"). These Terms of Use apply to the PuffLab website located at www.pufflab.ca, and all associated sites linked to www.pufflab.ca by PuffLab, its subsidiaries, and affiliates, including sites around the world (collectively referred to as "the Site"). The Site is the property of PuffLab ("PuffLab") and its licensors.
By using the Site, you agree to these Terms of Use. If you do not agree, please exit the Site immediately and refrain from using it.
PuffLab reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms of Use at any time. It is your responsibility to check these Terms of Use periodically for changes. All text, graphics, user interfaces, visual interfaces, photographs, videos, audio, logos, artwork, and computer code (collectively "Content"), including but not limited to the design, structure, selection, coordination, expression, "look and feel," and arrangement of such Content, contained on the Site is owned, controlled, or licensed by or to PuffLab, and is protected by trade dress, copyright, patent, and trademark laws, and various other intellectual property rights and unfair competition laws.
Except as expressly provided in these Terms of Use, no part of the Site or any Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including "mirroring") to any other computer, server, website, or other medium for publication or distribution or any commercial purpose, without the prior written consent of PuffLab.
You may use the information on PuffLab products that are purposely and expressly made available by PuffLab for downloading from the Site, provided that you: (1) do not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purposes and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) do not make any additional representations or warranties relating to such documents.
Your Use of this Site
You agree to use the Site only for lawful purposes and following these Terms of Use. the Site. You may not reverse look-up, trace, or seek to trace any information on any other user of or visitor to the Site or any other customer of PuffLab, including any PuffLab account not owned by you, to its source or exploit the Site or any service or information made available or offered by or through the Site in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your information, as provided for by the Site.
You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or PuffLab's systems or networks, or any systems or networks connected to the Site or PuffLab.
You may not forge headers or otherwise manipulate identifiers to disguise the origin of any message or transmittal you send to PuffLab on or through the Site or any service offered on or through the Site. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.
You may not use the Site or any Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity that infringes the rights of PuffLab or others.
Accounts, Registration, and Security
Certain features or services offered on or through the Site may require you to open an account (including setting up a PuffLab ID and password). You are entirely responsible for maintaining the confidentiality of your account information, including your password, and for any activity that occurs under your account.
You agree to notify PuffLab immediately of any unauthorized use of your account or password or any other security breach. However, you may be liable for losses incurred by PuffLab or any other user of or visitor to the Site due to someone else using your PuffLab ID, password, or account.
PuffLab reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.
Links to Third-Party Sites
The Site may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of PuffLab and PuffLab is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. PuffLab is not responsible for webcasting or any other form of transmission received from any Linked Site. PuffLab is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by PuffLab of the site or any association with its operators.
No Unlawful or Prohibited Use
As a condition of your use of the Site, you warrant to PuffLab that you will not use the Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.
Disclaimer of Warranties

Limitation of Liability
In no event shall PuffLab be liable for any direct, indirect, special, punitive, incidental, exemplary, or consequential damages, or any damages whatsoever, even if PuffLab has been previously advised of the possibility of such damages, whether in an action under contract, negligence, or any other theory, arising out of or in connection with the use, inability to use, or performance of the information, services, products, and materials available from this Site. These limitations shall apply notwithstanding any failure of the essential purpose of any limited remedy. Because some jurisdictions do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless PuffLab, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
Governing Law and Jurisdiction
These Terms of Use and your use of the Site shall be governed by and construed by the laws of the jurisdiction of PuffLab's headquarters, without regard to its conflict of laws principles. Any legal action or proceeding relating to your access to or use of the Site or any dispute or claim arising out of or in connection with these Terms of Use will be subject to the exclusive jurisdiction of the courts located within the jurisdiction of PuffLab's headquarters.
